What’s Rumor & What’s Fact? Advice from long term disability lawyers.

Here at the ERISA Law Center, we’re proud of the fact that we’re able to represent America’s disabled in helping them obtain disability, life insurance benefits, and much more. We’re devoted to serving our clients with professionalism, courtesy, and knowledge. We hear a lot of untrue rumors about longer term disability benefits. Some of these rumors travel well and seem so logical they’re accepted as fact by quite a lot of people. As long term disability lawyers, we’re here today to shed some light on some common rumors we hear and set the record straight.

Rumor: Social Security Disability turns everyone down the first time.

Truth: Actually, it’s about 50/50. The requirements are by no means liberal, but one of the primary reasons that people are turned down the first time is because they didn’t do their homework. We can make sure you do your homework the first time because this isn’t our first rodeo.

Rumor: If my doctor says I’m disabled, then they have to approve me.

Truth: Unfortunately many doctors even think this is true, but it isn’t. Both Social Security Disability programs has their own definition of disability and criteria.

Rumor: Your employer can’t fire you if you’re out of work on disability.

Truth: This just simply isn’t true. If you can’t do your job, your employer can let you go. The Family and Medical Leave Act prohibits the termination of certain covered disabled employees, but it doesn’t cover every worker and the works it does cover are only protected for up to 12 weeks.
