Advice from long term disability lawyers: Proving Disability

We've heard the question over and over, "How do I prove that I'm disabled?" Here at The ERISA Law Center, we're here to help you make sure you're able to not only prove you're disabled, but we also help you get approved for Social Security Disability the first time you apply. As long term disability lawyers, we take pride in the fact that we can offer our clients the professionalism and integrity they deserve while we help them with their claims or case.

So, how do you prove that you're disabled? Firstly, it has to be in your medical records. This is the primary source: you must establish disability in your medical records because Social Security will rely on that most to accept or deny your claim. Your medical records can include any and all physicians you've attended, your therapist, chiropractor, and even acupuncturist. Always list all medical doctors that have records on you. However, oftentimes doctors are either too vague or they're not taking complete notes so make sure your doctor knows your intentions and they're making thorough notes in your records. "Pain" won't normally cut it.

Oftentimes, you'll need more evidence, too. You may be asked for other sources of medical evidence. For example, you may be asked for a third party testimony such as a letter from your supervisor outlining your deterioration and how it has affected your job performance. You could be asked for a symptom diary that maintains a daily log of your the symptoms you're experiencing, their severity, and the impact these symptoms have on your daily life.
