  • An international lawyer from California with a heart condition and diabetes received a settlement approaching $1 million. The insurance company argued that his illness resulted from a failure to comply with the orders of his physician. ERISA Law Group attorneys successfully argued that this compliance was not a term of his disability insurance policy.
  • ERISA Law Group attorneys won a $200,000 verdict on behalf of a Michigan computer analyst who suffered from a heart ailment. The disability insurer denied his appeals and found multiple physicians who testified that our client was able to work. Our law firm filed a lawsuit and convinced the court that the medical opinions of these doctors were unduly biased in favor of the insurance company that was paying for their services.
  • A New York marketing executive received a $450,000 settlement. The insurance company insisted that outbreaks of her gastrointestinal illness did not occur frequently enough to prohibit her from working. Our ERISA attorneys were able to show that the condition was so severe that she could not engage in client meetings and other normal responsibilities of the job.
  • A New York graphic artist in the film industry was successfully reinstated “on claim” with the potential to receive $1.8 million. The disability insurer argued that his hand injury was a pre-existing condition. ERISA Law Group attorneys found that this provision had been invalidated by New York state law.
  • A California insurance company employee won her appeal to be reinstated on a claim with a potential to receive $480,000. Following a serious accident she suffered from postconcussive syndrome. Her disability insurer terminated her benefits after two years claiming that her injury was a mental illness, which is commonly limited to a two year period. Our disability insurance lawyers demonstrated that her medical condition had an “organic” physical basis and was not primarily a mental illness.
  • An insurance saleswoman with a back injury obtained a $260,000 settlement of her claim. The disability insurance company conducted video surveillance and produced tapes showing her walking and appearing to not be disabled. ERISA Law Group attorneys demonstrated that the disabling aspects of her medical condition were not portrayed by the video and undermined the credibility of this key piece of evidence.
  • We helped an Arizona banking officer win an appeal to be reinstated on his claim valued at about $150,000. Equally important, his victory enabled him to retain health insurance coverage to treat his illness.
  • A pharmaceutical inspector will receive benefits estimated at $914,000 over the life of his policy. We successfully disputed an insurance company claim that his disability from HIV/AIDS began after the end of his employment.
  • A warehouse supervisor with fibromyalgia received a $250,000 settlement. Our law firm overcame the challenge of proving disability where the medical evidence is less “objective” than other conditions.
  • An airline customer service representative will receive $324,000 over the life of his policy, following restoration of benefits. We successfully appealed two separate attempts by the insurance company to terminate his benefit payments, with a different rationale in each appeal.
  • A physician received a $165,000 settlement. Our ERISA law firm overcame the challenge of proving disability in a situation where our client had continued working on a modified schedule after the onset of her disability.
  • A physician received a $155,000 settlement. We successfully countered adverse medical opinions in this case.
  • A label inspector received a $150,000 settlement. After denial of an appeal, ERISA Law Group filed a lawsuit that brought the other side to the bargaining table.
  • A former key punch operator with multiple sclerosis had health benefits restored for herself and her spouse, as well as her life insurance benefits. This was more valuable than her $200 per month disability benefit that was also restored. She had been cut off by her insurance company after 20 years of receiving disability benefits.
  • A pharmaceutical sales representative with multiple sclerosis received a $39,000 settlement. Her insurer had terminated her benefits prior to the end of the contract time period, and ERISA Law Group successfully challenged their decision.
